Privacy policy.
Who we are
The Well Creative is a trade name of Jeremy Berry, a sole proprietorship based in Edmonton, Alberta. The business is not incorporated, so Jeremy Berry is the person accountable for personal information collected through this site.
To ask about this policy, to make a request about your information, or to raise a concern, contact a representative of The Well Creative at Hello@thewellcreative.ca. We respond within 30 days.
What we collect, and why
We collect personal information in one place: the contact form on this site. We use it to respond to your enquiry and, if we go on to work together, to carry out that work. We do not use it for any other purpose, and we do not sell it.
We collect nothing else through this site.
- Name — so we can address a reply
- Email address — so we can send one
- Selected service and project description — so the reply is useful
- IP address — to check the submission is not automated, and to limit how often the form can be sent from one connection
Consent
Submitting the contact form is how you consent to us collecting and using the information above for the purposes described. We ask for nothing beyond what answering your enquiry requires.
You can withdraw your consent at any time by emailing Hello@thewellcreative.ca, subject to any legal or contractual restrictions and reasonable notice. If you withdraw it, we may be unable to continue responding to your enquiry or to carry out work you have asked us to do.
Who else handles it, and processing outside Canada
These providers process personal information on our behalf so the site and its contact form can operate. We do not disclose your information to anyone else.
- Vercel — hosts the site and runs the code that receives your submission, so everything you send passes through it. Like any web host it records IP addresses in server logs, and it uses your IP address to limit how many messages can be sent from one connection.
- Formspark — receives and stores form submissions and forwards them to us by email.
- Cloudflare Turnstile — the anti-spam check on the form. To tell a person from a bot it processes your IP address and signals about your browser.
These providers operate outside Canada, so your personal information is collected, used, stored and disclosed outside Canada and is subject to the laws of the countries where they operate. You can contact a representative of The Well Creative at Hello@thewellcreative.ca for information about our policies and practices relating to service providers outside Canada, or with any question about how your information is handled outside Canada.
How long we keep it
We keep enquiries for as long as we reasonably need them — to answer you, and to keep a record of work we quoted on or carried out. When the information is no longer required for those purposes or for a legal reason, we delete it. You can ask us to delete yours sooner and we will, unless we are required to retain it.
How we protect it
The site is served over HTTPS, submissions are validated on our server before being passed on, and the form is protected by an anti-spam check. Access to enquiries is limited to those who need it to reply to you.
No method of transmission over the internet is completely secure. Please do not send financial details, identification documents or passwords through the contact form.
Your rights
Under PIPEDA and Alberta’s Personal Information Protection Act you can ask what personal information we hold about you and how it has been used and disclosed, ask us to correct it if it is wrong or incomplete, and withdraw your consent as described above.
To make a request, email Hello@thewellcreative.ca. We respond within 30 days. There is no charge for a routine request; if a request would carry a fee we will tell you before doing the work.
If you are not satisfied with how we have handled your information or your request, you can complain to us first at the same address. You can also complain to the Office of the Information and Privacy Commissioner of Alberta, at oipc.ab.ca, or to the Office of the Privacy Commissioner of Canada, at priv.gc.ca.
If you are in the United Kingdom or the European Economic Area, the UK GDPR and the GDPR give you equivalent rights over your personal information — including access, correction, erasure, restriction, objection and portability — and a right to complain to your local supervisory authority. To exercise any of them, use the same address above.
Children
This site is aimed at businesses and is not directed at children. We do not knowingly collect personal information from anyone under 13. If you believe a child has sent us their information, contact us and we will delete it.
